The legal perspective implicitly supports the intent of the ovum/sperm donors as the deciding element. If a woman wants her embryo, it's a baby, and anyone who deprives her of that is guilty of homicide. If she doesn't want her embryo, it's not a baby. When I say "least intrusive" I mean from the perspective of those who one virtue is that capacity to donate ova and sperm.
